SandBoxBlogs: Aspen Times "U.S. attorney: No pot shop safe from federal enforcement"

Will 2012 bring the final outcome?

Is this the year that the medical marijuana industry finally gets a straight answer on the question of whether to stay open or close the doors?  Finally get a break from lawyer fees and being hassled in the business community on all kinds of levels?  Be able to go to work without being afraid the cops are on their way?

Colorado US Attorney John Walsh says that it is.

Rema Rahman:
"DENVER — The U.S. attorney in Colorado says there is no such thing as "safe harbor" for pot shops.

U.S. Attorney John Walsh sent a letter Friday to a lawyer representing medical marijuana dispensaries, saying safe harbor doesn't exist for such shops because marijuana remains illegal under federal law. It was the latest in an exchange of letters between Walsh and lawyer Robert Corry regarding the location of dispensaries and how far they need to be from schools.

Walsh said in the new letter that it is at his office's discretion to take enforcement action against any and all medicinal marijuana dispensaries...."  (Read more? Click title)

SandBoxBlogs: Grand Junction Daily Sentinel "King’s pot DUI bill OK’d by panel"

This is terrific news.  A special thank you goes out to State Senator Steve King.  We're pretty sure law enforcement is grateful for this one.  For certain, our roads will be safer.

Charles Ashby:
"It was a battle of the scientists in a Senate committee Monday over whether there is any way to determine if there is a marijuana equivalent to the blood-alcohol level used for DUIs.

After nearly seven hours of testimony, most members of Senate State, Veterans & Military Affairs Committee agreed that the science was still murky, but said there was enough to set such a level for toking while driving...."  (Read more?  Click title)

SandBox Comments: Denver Post "16 charged in Denver-area pot-growing raids"

They are no longer sending warnings.  They are now here.

The Feds crackdown on all things marijuana is here.

It is not a false warning, it is not a drill, it's not a joke or a test.

Marijuana is illegal on federal levels and Colorado is in non-compliance just about everywhere when it comes to medical marijuana.

The Feds are here and they will come in, bust you, confiscate your business stock and shut you down.

Upset?

Call your local government and give them an earful.  Espcially your city, town or county attorneys.

It is through the negligence of their disregard for federal law when it comes to pot, that you are in the situation you are in now.

SandBox Comments: KJCT News 8 "US Attorney Walsh: Pot Letters Are Not A Bluff"

Let's see...this is what?  The third public notice in addition to the letters sent from the Feds directly to Colorado local governments?

Doesn't sound like those Feds are going to back down, does it?

So, why do we have Pitkin County Commissioners signing off on pot operations?

DENVER -- U.S. Attorney John Walsh says the federal government did not sit idly by as state lawmakers enacted regulations that have allowed Colorado's marijuana industry to boom the past two years.

Walsh says the letters sent to 23 marijuana dispensaries and their landlords near schools last week giving them until Feb. 27 to shut down or face federal penalties are no a bluff - and criminal prosecution is possible...."

SandBox Comments: Denver Post "Feds: Colorado medical-marijuana dispensaries within 1,000 feet of a school must close"

So it begins.

Wonder what the City of Glenwood Springs is going to do now that we move closer to federal closures and prosecutions of marijuana based industry?

At the very least one would think our city council would be bringing the subject up to the people.  Sounds like a good thing for Mayor Pro-Tem Leo McKinney to start tackling.

SandBox Comments: Grand Junction Daily Sentinel "Pitkin County to rethink inaction on medical pot"

Hard to remember why in the world Colorado ever thought it was a wise idea to make medical marijuana legal while marijuana in all forms is illegal on federal levels, isn't  it?

Our county and city and state employees can face legal penalties for handling transactions of any kind where MMJ is concerned.

Banks, landlords, lenders and merchant services cannot go anywhere near these MMJ businesses due to the legal ramifications.

We've seen crime numbers where all pot is concerned sky-rocket since the passage of the medical marijuana laws in Colorado.  And have no way of knowing until a generation or two passes exactly how much harm to our youth the easy access and exposure has done.

Yet, from what Dennis Webb is bringing us off the Sentinel, we now cannot even place moratoriums on all things MMJ because that too, will bring liability to the folks.

Hard to remember why in the world Colorado ever thought it was a wise idea to make medical marijuana legal while marijuana in all forms is illegal on federal levels, isn't  it?

SandBox Comments: KREX News 5 "Marijuana-Impaired Driving Rises in Colorado"

"Mesa County - A recent study conducted by the Institute for Behavior and Health says over the past five years, the number of drivers who tested positive for drugs, including marijuana, has increased.

"We're seeing a dramatic increase in the number of people that we are contacting and arresting for driving under the influence of marijuana," says Deputy Ben Carnes of the Mesa County Sheriff's Office.

Research shows that those who get behind the wheel within three hours of using marijuana are more than twice as likely to get in an accident.

"It severely impairs somebody's ability to multitask, it has a time distortion effect, it dilates your pupils and impairs your vision," says Carnes..."

SandBox Comments: Steamboat Today "County, Steamboat and Oak Creek voters OK marijuana dispensaries"

"Steamboat Springs Police Department Capt. Joel Rae, who publicly supported a ban of medical marijuana businesses, said he was disappointed in the vote.

“But I have complete respect for the democratic process,” he said. “We’ll continue working, doing our education efforts and working with the dispensaries with the regulations our Steamboat Springs City Council has set forth and the regulations the state has set forth....”
