SandBox Comments: Aspen Times "Aspen man accused of selling Ecstasy"

Update December 30, 2011

As with the current saga of homeless man Jimmy Baldwin being shuffled between North Dakota and Aspen continues; let's deal with the news reporting of Max Puder in the same way.  Just update the original post.

There are (3) relevant stories in today's local news.  Two different styled reports off the Times and the Daily.  And a story off the Times regarding PitCo taking another look at whether  or not to even  allow medical marijuana operations to increase in the city and county (or) to ban them altogether in light of all the problems that industry faces.  Including federal laws.

Why does an 18 year old kid have a medical marijuana card?

"...Chief Deputy District Attorney Arnold Mordkin said he will file charges at Puder's next court appearance, set for Jan. 9.

Puder's parents attended Wednesday's advisement hearing, which Nichols conducted via speaker phone from her office in Glenwood Springs. His father said the family is focused on putting Puder in a rehabilitation facility so he can get on the right track.

Should Puder post bond, he will not be allowed to consume alcohol or take illegal substances. That includes marijuana, even though Puder is a registered marijuana patient.

“No pot. No marijuana,” the judge said.

The family has hired Yale Galanter, a defense attorney who practices in Aspen and outside of the state.

It's a great question.

Medical marijuana is supposed to be for chronic pain, terminal illness relief. What could an 18 yr old kid have wrong with him that he needs an mmj prescription? Is he terminally ill?

Do they not even screen people for substance abuse issues before they give them an RX?

Interesting. He is healthy enough to be a standout player in High School football, but his doc thinks he needs Medical Mary Jane for something. Maybe he needs it to come down from the X?

Well, at least his parents are rich enough to hire one of O.J. Simpson's former attorneys ! Not everyone would be so lucky.

What's mind numbing about this 18 yr. old kid, in the upper family wealth bracket of Aspen, having an MMJ access and selling dope outside a nightclub to a 30 year old local drunk is that the first thing his parents do is pull a red carpet exit by pushing him into rehab before he gets the fear of God struck into him by the judge. He probably won't even have to appear until they get him cleaned up.

Here's the mind numbing part.

There are more kids like this in Aspen than the newspapers will ever know. Don't tell the average citizen of the Roaring Fork Valley that dope doesn't run through the streets of Aspen.

Time for more DEA busts to nail down where this stuff is coming from. They aren't cooking it in the kitchens of the mansions.

I think it's past time for our special agents, chiefs and sheriffs to be making the public more aware of everything that's going on.

We have kids to teach on what to watch out for, where to look out for anything coming and where to stay away from.

To lose a little bit of the element of surprise for busts or run the risk of puffing up some of these bangers chests with ego is worth it.

We're the ones who have to live with this stuff out here. We're the parents and we need to know.

Good to know from the Daily today that Schrant's not backing down to DiSalvo. These kinds of stories like Puder and the Simmons bust all go back to the same points commentators talk up all the time.

That there are more people in our area that want the security and safety of each agency just doing the job that they have. The minority is big money and cronyism. They aren't the majority.

If the Simmons bust goes south because Fain screwed up in the ID, then it goes south. Pretty obvious that Garco and Mordkin made sure Simmons is going in on something because of the parole violations. Too bad that we don't have a DA that's above board in that kind of aggressive tactic and instead have one that does things like that as gotcha. But then an election would deal with that problem if somebody else would just step up.

What I'm after here is that I seriously doubt that "anonymous father" is too worried about his detailed tip on Simmons doesn't get prosecuted because Fain screwed up. He made his point loud and clear. If you come after our communities with dope and target our kids or our lives, we will turn you in because we don't want you here. There isn't one of any group of people out here that feels the way they used to a few years ago. Just turn the other cheek and don't look because if you get ratted out for noticing, you'll be community persecuted for it. Nobody really feels that way anymore because there's been way too much of this apathy and soft corruption of duty floating around. People are mad as hell and are not going to take it anymore. They'll stay safe and most all of us believe strong in our cops and our justice system. May not have as much faith as we used to but we still believe.

Agents like Schrant and a Sheriff like Lou are enough to hang on to until we can see the results of all our pushing back out here.

Puder needs no free ride like Brooke Mueller's getting today. And Simmons is a major dopeman who's house, according to the kids, has been like what they found for a long time. Sick mother or no. Next time, cops will do it right. The point I'm winding up for here is this:

Maybe knowing there's no more tolerance from his communities he serves, Max Puder and Thomas Simmons will get off the dope.
