 Unconstitutional Election Practices

"Denver, Colo. February 13--Citizen Center, a nonpartisan group of Colorado voters, filed a lawsuit in the U.S. District Court for the District of Colorado today seeking an injunction and declaratory judgment requiring Secretary of State Scott Gessler and the county clerks of Boulder, Jefferson, Larimer, Mesa, Eagle and Chaffee counties to immediately halt practices that violate voters' constitutional rights to vote anonymous, untraceable ballots.

Today's legal action seeks to correct election practices in order to restore voters' federal constitutional rights-the fundamental right to vote, freedom of expression, freedom of association, right to due process, and right to equal protection-and the state constitutional right to vote a secret (anonymous) ballot without which those federal constitutional rights cannot be freely exercised.

"The right to a secret ballot is a revered principle of American democracy. No one, most particularly government officials, should have access to information that can connect ballots with voters," said Marilyn Marks, founder of Citizen Center, citing the urgent need for remedies in advance of Colorado's 2012 elections.

Citizen Center has found that many Colorado counties employ procedures that collect information making it possible to identify the individual who voted a specific ballot. The Citizen Center's legal action comes months after the Secretary of State failed to enforce compliance in response to voter complaints filed with his office.

Scott Gessler: Colorado will join seven other states in a new initiative aimed at identifying voters who move across state lines — an effort Secretary of State Scott Gessler said will help clean up voter rolls and could lead to the largest voter-registration drive in state history.

The program is organized by the Pew Center on the States, which issued a report saying about 24 million, or 1 in 8 active voter registrations in the United States, are "significantly inaccurate or no longer valid."

About 12 million records have incorrect addresses, and more than 2.7 million people are registered in more than one state, according to the study.

The new initiative will use state voter-registration information, driver's license and state identification databases with other data to flag voters who may have moved from one state to another. Currently, it can take states years to determine someone has moved. Under the new program, those people may be identified within as little as 30 days.

States will use that information to contact new or unregistered residents and let them know how to register to vote.

In Colorado, Gessler estimated up to 1 million people could fall into that category. He expects to send them registration information this spring.

States also will be able to contact voters who have left the state to ensure they want to be removed from voter rolls. Voters will keep ultimate control over their records, Pew officials and Gessler said.

Besides Colorado, participating states are Washington, Oregon, Nevada, Utah, Maryland, Delaware and Virginia.

Once duplicates among categories are eliminated, approximately 24 million registration records, or 13 percent of the national total,
are estimated to be inaccurate or no longer valid.

Approximately 2.75 million people have active registrations in more than one state.

Meanwhile, researchers estimate at least 51 million eligible U.S. citizens are unregistered, or more than 24 percent of the eligible population.
