SandBoxBlogs: Watchdog.Org "IA: Secretary of State denies release of emails related to identity theft case"

Good for Iowa Sec of State Matt Shultz.  Who was exonerated from accusations of state ethics law violations.

This was the first case in the judicial history of the United States where law enforcement took charge of the outdated, vague and sorely lacking 'identity theft' laws when it comes to internet crime. 

Because Shultz is a public figure and not a  private citizen made the courage of law enforcement to take on now convicted Zach Edwards and the infamous 'Link Strategies' company he was associated with even more significant. 

Public figures have far less ability to protest attacks on their lives from false allegations or types of viral assaults such as Zach Edwards did.  Private citizens attacked in similar manner are protected more strongly by the 4th amendment.  Even though the act committed against both is the same.

Kudos to Matt Schultz for keeping hands on the reins and not letting media fester what is now a historic ruling that benefits all victims of internet crime and 'high-tech lynchings' by others.

"DES MOINES – The Iowa Secretary of State’s Office is refusing to make public emails related to an identity-theft case involving its elected leader Republican Matt Schultz and a former Barack Obama presidential campaign staffer.

Iowa Watchdog asked the secretary of state’s office multiple times for emails related to the case. It also sought access to all documents associated with the former Obama staffer, Zachary Edwards, including written correspondence, emails, police reports, phone logs and written notes to staff......

.......Edwards, 29, committed identity theft when he sent at least one email saying Thomas Schultz received inappropriate payments from former GOP presidential nominee Rick Santorum, court documents show. He sent that email to Matt Schultz’s Secretary of State office from an email address that was almost identical to the secretary of state’s personal address.

Edwards was also behind a libelous blog post that prompted articles in The Salt Lake Tribune and
Politico.com accusing Thomas Schultz and his brother of engaging in unethical or illegal behavior, according to Thomas Schultz’s victim impact statement.

Around the same time, Matt Schultz, 33, faced an ethics complaint for using his office to issue a statement sharply criticizing Jon Huntsman for his failure to participate in the Iowa Caucuses. Matt Schultz received at least $12,500 in campaign contributions from a political action committee Santorum ran. Thomas Schultz was behind the Draft Santorum website urging his candidacy for president.

The Iowa Ethics & Campaign Disclosure Board later tossed out the complaint, saying Matt Schultz didn’t violate state ethics laws......"  (Read more?  Click title)

This type of internet crime just pulled off by 'Anonymous' "hacktivists" is the type of internet crime that CISPA appears to target.

The problem seems to be that some of the language within CISPA is still too broad and needs to be tightened up.

SandBox agrees, when it comes to this radical group and these types of acts,  with USTelecom CEO Walter McCormick Jr:

Facebook is not your friend.

Nothing on the internet is safe.  Nothing on the internet is confidential or private.  You are not safe nor is anything in your life or anyone you care for safe when you are exposed on the internet at either your hand or anyone else associating content to you.

Yet, there is an entire sub-culture out there of  internet crime being committed every day that very few law enforcement officers are even aware of, let alone will act upon to serve and protect you.

It is a sub-culture that the folks shout out for help with every day. 

One that is responsible for the worst types of crime and the consequences of those crimes.  Harassment, stalking, menacing, intimidation and often the literal stripping away of all aspects of life as an individual knows it.  The consequences are the destruction of financial security, peace and privacy, relationships that often lead to irretrievable actions such as suicide.  Worse, the weapon of the internet is a perpetual firing weapon.  24/7 and never runs out of ammunition.

'SandBox Nanny' wonders what it will take the folks doing in order to get the attention of lawmakers and law enforcement. 

Watching the path of SOPA was like watching the old black and white cartoons of cops and robbers chasing each other in circles.  While we are good people who greatly appreciate anyone at least trying; it was disheartening to watch the debacle of SOPA run its course when the answer to the problem is so, so simple.

In the past three years of lending her forced on her notoriety first to 'smalltown7' and then creating the offshoot of 'SandBoxBlogs' and 'SandBox Nanny' in Spring 2010; one of the news aggregate topics she chases is internet crime.  Most of the feedback she receives from the general public is related to the juggernaut of power that the media holds.

The internet is the most powerful media outlet in history.

Interestingly enough, it was the State of Iowa and an investigative reporter by the name of Kevin Hall off the Iowa Republican who brought us the story of Zach Edwards and Link Strategies.  (Be sure to click on all related links within that post link on Edwards)

A story that will be one of the most important baseline foundations of our time for lawmakers when it comes to putting parameters on what is "OK" to do on the internet and what is not. 

That seemingly insignificant case, that was near immediate quashed from public view by high power and big money politics, is the first case of a powerful public figure winning his claim that viral link baiting and SEO optimization is criminal in nature when it is used with ill intent and in negative context. 

To have the Iowa Sec of State win against one of the individuals who lurk in the bowels of the internet preying with intent on their subjects was groundbreaking.  Just like the folks know 'who' does harmful things in their communities; anyone who does business on the internet knows where the worst forms of media exploitation come from in the world of SEO, mass marketing and perception management companies.  Sometimes the world of internet business survival is based on spending the time and effort it takes to stay out of the clutches of those who practice marketing with ill-intent.

'SandBox Nanny' wonders what it will take to get lawmakers and cops to listen to all the folks who suffer every day from the real problem of  public exposure at the hand of another. 

Such a simple criminal element to notice and yet it slips by cops every moment of every day.

That element they need lies in the tools (weapons) that ill-intent individuals have available to use against others. 

Lawmakers keep trying to control the internet itself when simply regulating the power itself and not the content is the answer.  'Negative Viral' is a programming technique and is a literal mechanism.  Not a 'happens by chance' nebulous and undetectable concept that can be lumped into the category of "bullying".  The level of skill an internet perp uses determines how much collateral damage they can achieve.  A well-known pro like Zach Edwards and Link Strategies has unstoppable power due to their intellectual property enhancing the tool of viral linking.  Talk about Medusa or Pandora!

Maybe it will take more consequences.  More horrific consequences such as drug cartels murdering female reporters they find on viral mechanisms like Twitter, vulnerable young adults committing suicide, government officials and politicians literally destroying business owners and citizens lives with the power of the media.

From the tool of a free 'Blogger' blog, and the patience to earn followers and recognition the good old fashioned way with true public content and in the manner that the internet originally intended; we'll keep plugging away with our mission to get the voices of the folks heard.

It shouldn't take more consequences before our lawmakers and law enforcement simply halt the juggernaut of irretrievable consequences, toss off all the cloudy layers of spin and return back to good old fashioned gumshoe police work.

(whisper...whisper...whisper...for every Alvaro Agon...every Sheriff Vallario....every Scott DeGraff.....that find themselves plastered for all time and all over the web....there is 'somebody' picking up the ammunition of words and loading those words into the weapon of viral link baiting and marketing.....and then deliberately and with intent.....pulling the trigger repeatedly at will.....whisper...whisper...whisper....)

"Democrat operative Zach Edwards changed his initial not guilty plea to guilty and received a light sentence for stealing Secretary of State Matt Schultz’s identity. The plea was officially filed by Iowa Courts on Thursday. He pled guilty to identity theft, a simple misdemeanor.

Edwards received a deferred sentence of one year probation, 20 hours of community service within 120 days and a $65 fine. If he completes probation successfully, the simple misdemeanor charge is dismissed without a conviction being entered on his record. Edwards was originally charged with an aggravated misdemeanor and faced a maximum of two years in prison and a $6,250 fine. He was represented by prominent Republican attorney Matt Whitaker.

Zach Edwards was the Iowa Director of New Media for Barack Obama’s 2008 presidential campaign. At the time of his arrest, he served in a similar capacity for Link Strategies, a Democrat consultant group closely aligned with Iowa Senator Tom Harkin and several prominent Democrats around the country.

The Iowa Department of Public Safety said Edwards tried to use the identities of Secretary of State Matt Schultz, and/or his brother Thomas, with the intent to falsely implicate Secretary Schultz in illegal or unethical behavior. The Secretary of State’s office discovered the crime and reported it to authorities. "The former Barack Obama campaign staffer who was arrested for trying to steal the identity of Iowa Secretary of State Matt Schultz pleaded not guilty to the crime. Zach Edwards of Des Moines entered the written plea on Friday and avoided a preliminary hearing that was scheduled for Monday.

Edwards was arrested on January 20 on the charge of identity theft, an aggravated misdemeanor. 

According to a press release from the Iowa Department of Public Safety, “Edwards fraudulently used, or attempted to use, the identity of Iowa Secretary of State Matt Schultz and/or Secretary Schultz’s brother, Thomas Schultz, with the intent to obtain a benefit, in an alleged scheme to falsely implicate Secretary Schultz in perceived illegal or unethical behavior while in office.”

At the time of the alleged crime and subsequent arrest, Edwards was an employee of Democrat consulting firm Link Strategies. The group has ties to Senator Tom Harkin, Attorney General Tom Miller, former governor Chet Culver, President Obama, and several prominent Democrat officials around the country. "Greetings and welcome to Kevin’s Korner. This has to be the craziest week in Iowa politics I’ve ever seen, so lots to yap about today. Sit back, crank the volume up to 11, and get ready for a bumpy ride.

My quick thoughts on the South Carolina primary: Newt Gingrich has two people to thank for his landslide victory … Juan Williams and John King … The moderators at the two debates last week inadvertently handed Newt the moments he needed to change the race.

Meanwhile, Mitt Romney blew it. He should have wrapped us this race yesterday, but Mitt’s inability to answer simple questions about his tax returns seriously hurt him … I was getting emails from Ron Paul earlier this week claiming it was a “two-man race” between him and Romney … Dr. Paul, there are four candidates left. You’re the only one who has yet to win a state. Go sell crazy someplace else. We’re all stocked up here...."

SandBox Comments: BREAKING NEWS - Iowa Republican/Kevin Hall "Link Strategies’ Dirty Deeds and Deep Ties to Top Democrats'

Kevin Hall off the Iowa Republican broke this story last Friday and follows through today. 

Naming names out in Iowa and all the way on over to the Oval Office.

This story very well could be the most major story influencing the growing need to determine laws that govern internet use.

Edwards and Link Strategies are known all over the web for their cutthroat style of viral link baiting, search optimizing practices and ruthless web content.  All of our existing laws and the unwillingness of cops, prosecutors and judges to push the boundaries of those laws are the biggest travesty of justice we have when it comes to internet crime and intellectual, intangible property.

If you have never been through the labyrinth of trying to find the path to obtain protection for your person, life and loved ones should you find yourself a victim of these near indescribable crimes; you cannot begin to understand the importance of our lawmakers and authorities at least trying to wade through with things like SOPA.

'SandBox Nanny' recalls the words of a regional judge:

'Due to the negligence of legislators to define within the confines of law the specific wording that the internet and keyboard are the weapons of a stalker, I cannot grant you protection at this time.'

Well said.  Yes, some internet laws have enhanced since she heard those words spoken. But not anywhere near enough and they've missed the most fundamental core of the problem.

Web content with ill-intent or purposefully crafted into a falsity is criminal liability.  What turns that into a criminal act is the weapon of programming with viral based technology and manipulating that through SEO capability.  Enhanced by the intellectual property of the perpetrator and their level of skill.

Thank you to all officers, agencies and prosecutors who nailed Zach Edwards.  It will be very interesting to watch this story.

"Link Strategies’ ties to top Iowa Democrats run deep. First District Congressman Bruce Braley paid the group $167,237 in 2009-10. According to reports filed with the Iowa Ethics and Campaign Disclosure Board, the campaign for Secretary of Agriculture candidate Francis Thicke paid Link Strategies $100,000 during his unsuccessful 2010 run. Attorney General Tom Miller’s campaign paid the firm $1,200 on November 5, 2010.

The Des Moines-based consulting group also provided research to Chet Culver’s 2006 gubernatorial campaign. Link Strategies alum Matt Paul is the communications director for the USDA, run by former Iowa Governor Tom Vilsack. Paul was also Vilsack’s Iowa press secretary.

Link Strategies is also on the payroll of Democrats around the country. “Since 2004, Link Strategies handled research for the several successful campaigns including Sen. Tom Harkin (D-IA), Governor Ted Strickland (D-OH), Governor Chet Culver (D-IA), Sen. Amy Klobuchar (D-MN), Sen. Claire McCaskill (D-MO), Sen. Ben Cardin (D-MD), Rep. Brad Ellsworth (D-IN), Rep. Earl Pomeroy (D-ND), Rep. Chris Murphy (D-CT), Rep. Ron Kind (D-WI) and several other U.S. Senate, gubernatorial and congressional candidates,” the group’s website claims.

Barack Obama’s 2008 campaign was also a beneficiary of the services of Link Strategies. Zach Edwards was the director of new media for Obama’s Iowa general election campaign and also worked in several primary states. Jeff Link “served as a media consultant to the Obama campaign, coordinating branding, all paid media and polling in 25 states.” Brad Anderson, also a member of the Link Strategies team, was Obama’s Iowa communications director for the 2008 general election...."
