So good to hear that Source Gas remains remembering that the teeny tiny bit of real information, that was piled into ten million tons of disinformation by a single source that started the snowball panic attack against the much needed compressor station; is the sole source that began what has turned out to be a high loss to CMC credibility.
Bottom line is that no matter how CMC now tries to package up their retreat and attempt to market it to the public at large; they entered into a legal lease agreement that Source Gas had no reason not to trust.
At least not until the 'one ringie-dingie' campaign started up from the usual sources that sort of thing usually comes from in Glenwood Springs.
Who loses?
The land and money grabbers who started the ruckus and then threw the jet fuel of disinformation on to the flames of their creation?
Or the taxpayers who will be footing the bill for this very costly stance of CMC Trustees who caved to that pressure?
Actually, it is every student who enters the CMC campus for a number of years to come who ultimately is hurt by this incredible waste of monetary resources by the Trustees. The taxpayers and general population of surrounding areas suffer the loss of credibility. At least until the next election cycle when Trustees can be swept out.
Good luck to Source Gas on this and thank you to Judge James Boyd for erring on the side of fairness. May Source prevail in their quest for monetary damages.
John Colson:
"The judge did not dismiss the entire SourceGas suit outright, as requested by CMC, leaving open the company's ability to sue the school for monetary damages.
The company has claimed that it spent roughly $2.5 million on equipment, engineering and planning for the proposed CMC site, and that shifting to another site will entail more costs.
SourceGas attorney Timothy Knapp told the Post Independent on July 7, following Judge Boyd's previous ruling, that the company would be seeking monetary damages from the college...."

SandBoxBlogs: Glenwood Springs Post Independent "CMC sticks with its rejection of compressor station"
Should Pat Chamber run again for CMC Trustee, just say YES.
One has to wonder what defines 'education' in the Trustee's eyes. The loss of $12,000 in revenue per year that would pay a lot of overhead on our local CMC campus.
Remember, this is a dispute over a noxious weed infested patch of land that even the donor's families refuse to maintain and our Trustees do absolutely nothing with.
What's on the agenda for this ground if no revenue is generated off it?
Another few decades of continued neglect or is there some secret campus expansion or learning mecca planned for the spot?
Inquiring minds want to know exactly what 'education' is set for this land.
John Colson:
"News of the lease was met by an uproar among students, faculty members and landowners living near the college, including ranchers who had donated land for the school's campus back in the late 1960s and early 1970s.
The furor prompted the trustees to reconsider Jensen's agreement.
Less than two weeks after the May 14 meeting, SourceGas filed a lawsuit asking a judge to force the school to allow the compressor station to be built on campus property. The company also asked the trustees to consider a proposal to put the compressor station at a second site, near the school's water tower.
The majority of trustees this week appeared unswayed by the threat of continued legal action against the school.
“We're here to do education,” said Trustee Kathy Goudy of Carbondale, “and this is not education.”..."

SandBoxBlogs: Glenwood Springs Post Independent/Your Letters "Gas association questions CMC's compressor position"
What and how Marianne Ackerman, associates and others launched as the 'Great CMC Compressor Station Scandal' was outrageous behavior. Below the belt, uncalled for and an embarrassment to us all.
It was disappointing and disheartening to watch our CMC Trustees cave to that kind of display and pressure. Especially to know read in recent articles that they are 'revisiting' what is nothing more than simply a new approach for the same end result. We have far greater needs at CMC to spend limited funds on than attorneys and wasted time.
In the absence of our Garfield County Commissioners doing anything, how very good it is to see an authoritative and highly respected power in WSCOGA stand up and raise their voices. Calling a spade a spade.
David Ludlam, Executive Director West Slope Colorado Oil and Gas Association:
"The West Slope Colorado Oil and Gas Association, in a recent letter to the Colorado Mountain College Board of Trustees, expressed its confusion and frustration over the board's decision to vacate a contractual agreement with SourceGas to add a natural gas compressor station desperately needed to continue delivering home heating fuels to residents and businesses between Rifle and Avon.
The letter, available on our organization's website (www.wscoga.org), highlighted a special ongoing partnership between the energy industry and CMC's funding. According to Garfield County Assessor records, CMC receives up to $13 million annually from the oil and gas industry based on assessment of local oil and gas production. This is in addition to millions of direct philanthropic and curriculum contributions made to CMC by oil and gas companies.
Building and expanding energy infrastructure in America is challenging, in part because public constituencies are resolute in not wanting to be inconvenienced with infrastructure required for energy delivery and a modern standards of living. With this challenge in mind, WSCOGA communicated its frustration to the CMC trustees over their decision to vacate an established contract with SourceGas, which had made a significant financial investment including the full prepayment of the 20-year lease with CMC.
Local businesses and homeowners have the most to lose with this decision. In our view, the real losers are commercial customers, such as the Aspen Skiing Co., as well as upper Roaring Fork Valley homeowners, who will be inconvenienced if natural gas supply is disrupted during the coldest months of the year.
We also find it inconsistent for a public institution such as CMC, which is a major SourceGas customer and consumer of natural gas heating fuel, to be philosophically opposed to hosting commonplace infrastructure required to delivering the very fuel necessary for living year-round in the mountains of the Roaring Fork Valley.
Finally, what is the message the CMC trustees have sent to students about the sanctity of contracts and the importance of the collaborative process by failing to honor its commitments and engage with SourceGas on this matter?...." (Read more? Click title)

SandBoxBlogs: Glenwood Springs Post Independent "CMC to reconsider ‘water tower site' for gas compressor"
One has to wonder if anyone has gone to Marianne Ackerman and asked her if it all really was worth it?
Her legendary gossip and resulting back-door campaigns to 'raise a ruckus' are infamous in the valley. Have been for years.
All this money now being spent on lawyers, lawsuits and not on the education needs of our CMC students certainly does not seem 'worth it' at all. After all, that noxious weed filled patch of ground donated by her family and others has been virtually ignored for all these years by those donors children.
Yes, it certainly cannot be denied that the 'CMC Compressor Station Scandal' is all about the money.
In one way or another.
John Colson:
"While plans are made for that discussion, attorneys for CMC and SourceGas are expected to file motions in the SourceGas lawsuit against the school.
The suit is meant to force the college to honor its 2011 contract and allow construction of a natural gas compressor station along a pipeline that runs under the school's 680-acre campus property in Spring Valley.
SourceGas says the compressor is necessary to boost pressure in the line to better serve customers in Eagle County as well as in the Roaring Fork Valley.
The school's CEO, Stan Jensen, signed a lease agreement in August 2011, permitting the project on a five-acre site located over a ridge from the campus.
A subsequent outcry from students, faculty and neighbors of the campus prompted the trustees to reject that lease at a meeting on May 14.
The suit was filed in Garfield District Court on May 23..." (Read more? Click title)

SandBoxBlogs: Glenwood Springs Post Independent "CMC weighing $63.1M budget for 2012-13"
Hmmm....let's see.......$12,000 a year that could be income off the Source Gas compressor station lease...would buy....the entire projected budget for financial aid funds!!.....1/3 more than is projected to be spent on academic support and student services!!!!....hmmmm....support a college education for the kids of all the little guys by protesting the 'fauxtrage' directed at CMC!!!.....hmmmm......"one ringie-dingie"...."two ringie-dingie"....(see recent related posts, links within posts and public comments here)
Here's to the little guy.
Let freedom ring.
John Stroud:
"GLENWOOD SPRINGS, Colorado — The Colorado Mountain College board of trustees is in the process of reviewing a proposed $63.1 million general fund budget for next year.
And the general public can do the same between now and the CMC board's scheduled budget vote on June 18, according to CMC officials.
The draft 2012-13 budget can be viewed at any CMC location, including locally in Glenwood Springs, Spring Valley, Carbondale and Rifle. It can also be found online at http://www.coloradomtn.edu/, under the “Communities & Friends” tab (click on Board of Trustees/Budget & Audit).
The proposed spending budget represents a $4 million increase over the current fiscal year. That's due in part to revenues being slightly higher than projected for this year and continuing into the next fiscal year, according to a summary of the budget proposal.
Total revenues are projected at about $63.3 million, including $46.9 million from property taxes within the multi-county special community college district......" (Read more? Click title)

SandBoxBlogs: KDNK "Weekly News Brief: Compressor Conundrum"
Terrific interview by Erick Skalac of longtime local journalist Lynn Burton on the kerfuffle over the Source Gas compressor station.
Folks have been raising their eyebrows over a couple of points. One could say those points are facts. If that offends, then one could simply say current opinions of the common man over the 'one ringie-dingie' campaign to ban Source Gas off the map in Spring Valley are simply realistic expectations based on the little guy's experiences with leaders of that campaign.
SandBox runs with Lynn Burton on one point. That there's a high probability that it's really about the money and power. Though Lynn did say same in fancy speak with a more diplomatic edge.
And also runs with Eric Skalac on the spot in question being the perfect location for a public utility. It's a weed patch, folks. One that is never maintained, the building would obstruct no views and there is little to no proof that it would have a negative environmental impact.
Again, strong appearances that what this is really about is the money and the power capable of bullying CMC.

SandBoxBlogs: Glenwood Springs Post Independent "CMC trustees dump SourceGas lease agreement"
Disappointing at best, that our CMC Trustees decided to punt instead of lead.
Once again, commentators appear to have been spot on in their observations over the compressor station issue. Nothing is going to satisfy the small minority that have made protests.
What they really appear to have been after is a complete withdrawal from Source Gas yet no interruptions to their quality of life served by Source Gas fueling their homes.
In addition, perfectly content to be 'non-involved' with CMC admin to the extent that Jensen had no concerns or any inkling of an idea that he was creating a public protest when he negotiated the original lease.
Folks could also observe now that the 'shaming' of CMC by Marianne Ackerman that raised such a ruckus was completely ineffective and negative in outcome. Simply getting in touch with the trustees and expressing a respectful opinion would have sufficed.
Can our CMC trustees really be blamed now for taking the easier road out and simply letting the courts be the bad guys? Not really. As that is exactly what is going to happen now with the only outcome being the same one at the onset of all this controversy.
Source Gas is a public utility that has a critical need that takes care of many people, not just the few that wanted a big show yet somebody else to handle the leadership and legalities. There will be a compressor station up on Spring Valley.
Only question that remains is if it will now be force placed onto one of these protesters private property or if it will be placed in the best spot all along.
Which is right where CMC negotiated it to be in the first place.
Predictable and not surprising that our trustees decided to punt, take the easier road.
Yet disappointing that they decided in the end to not lead.
John Colson:
"During a public comment session, the board's decision drew a mixed response...."

Speaking of the natural law of cause and effect, trickle up and trickle down consequences; the folks can look around the past decade or so of heightened clarity and be grateful that some things in life, like the good old-fashioned gossip/party line just never die off. Why? So they can recall the natural role of Darwinism in our lives and the need sometimes to call in the power of natural equalizing force. Which is always the personal power of thinking on your own rather than through third party agendas.
'.....one ringie dingie....two ringie dingie...three ringie dingie.....'oh, good!....says the 'aging party liner aka spider to the fly'....'here comes one of my "robo" ringie dingies who can be number four'....'so nice to see how well those previous little cultivations of preying on another's weaknesses turns out on my behalf'....ring...ring....hello?....oh, dear.. party line must be having issues again....now, let's see...who can I ring up now, said the 'spider to the fly aka aging party liner', that I have cultivated from the past...."
Jenell Hilderbrand:
"I wonder what the people who donated the land in Spring Valley to Colorado Mountain College for educational purposes would think of the gas company, SourceGas, putting a compressor site on that property. Is CMC gaining financial rewards from this? These decisions seem to be made prior to public meetings and is a public upset."

"Good job by Jensen. This is where the whole thing should have stayed, should never have been tattled on to BOCC and letters to the editor. That kind of phone tree fauxtrage rounding up back strokers is a thing of the past.
Here's what I think about the compressor station itself. It's not about the station, it wouldn't matter if they hid the thing decked out as a high-end custom build exterior. These neighbors up in Spring Valley have been deadset against any kind of build, any kind of growth. CMC only thinks they would have smooth sails if they wanted to build more campus on these lands. Nothing, nothing is going to please these people. The proof of that is in the years worth of project bid submittals for developing Spring Valley. Go to bid clerk or Dodge reports and surf for Spring Valley under the parameters of the past 15 years. Then sit back and see the glimpse of the hard hitting cronyism politics that CMC trustees are really dealing with here. Nothing will please these people. You watch now, this new spot is going to be met with the same ruckus by the same people. Just under a different hat.
Source needs the station, natural gas is a natural fact of life. The best spot for it was the one just left behind. Since that is gone now because everyone that is above board and not steeped in self-interests took the high road and let these people go through democracy without looking into history, that ideal spot is a no-go.
The trustees did what we elected them to do and bent over backwards as diplomats. That's done now, let's get down to the business at hand and be done with it. No more delays.
Nice job, CMC trustees." (April 12, 2012)

If you are not of a certain age and/or never lived rural while growing up, you probably have no idea how a party line telephone system worked.
Or remember Lily Tomlin and her 'one ringie, dingie...two ringie, dingie' schtick.
You may know how to text message however. May even understand the basis, theory and execution of mass viral marketing. Or simply know what you know because you've experienced the fast thumb action of your teens sneaking their phones at the dinner table or been the receiving end of the power of the internet.
The concept of them all is the same.
What happens when you take an aging 'party liner' who literally has an entourage wake tailing her at all times and put her in the media spotlight?
Why, it's safe to bet that she's going to get on the horn and stay glued to it for as long as anyone can be 'stirred into action'.
The days of party lines and gossip chains of the old school really passed quite some time ago.
Instead, what we have now in this day and age, in a growing portion of the social classes, is something called tolerance and equality. Good communities just don't suffer covert bullies well anymore. Not much room at the Inn.
You see, an 'aging party liner' could take a different track and probably find more respect for her position if she did so. There were so many great suggestions from the general public on the CMC compressor station story when it broke (click links within post) that show the way.
Join our trusted, respected and appreciated CMC Trustees instead of the fauxtrage in the background. The compressor station must happen. It is a given and is coming.
Wouldn't it be nice to find a home for it and a way to make it fit in to the Spring Valley community instead of this old, tiresome and blatantly obvious PR push?
just sayin.
David Evans:
"I recently searched Wikipedia for more information about gas compressor stations like the one proposed for the Colorado Mountain College campus. I learned that “Natural gas compressor stations are known to cause many environmental problems, including air pollution, water pollution, soil contamination and noise pollution.” Some sites have emitted extremely high levels of carcinogenic and neurotoxic air pollution.
I watched videos on YouTube that documented extreme noise emissions, explosions and fires at several gas compressor stations. The Hollywood film “Erin Brockovich” documents one community's difficult fight to stop and clean up chromium VI and other toxic chemicals that were released into the soil and aquifer from a gas compressor station.
Any decision to install a gas compressor station on CMC's residential college campus should be made with very careful consideration of the risks involved and the measures the gas company is planning to make sure that the above environmental problems cannot happen in this installation.
The articles in the Post Independent I have read describing this proposed installation have not mentioned any such due diligence on the part of either SourceGas or Colorado Mountain College.
Spring Valley is a very quiet, environmentally clean corner of the Roaring Fork Valley. It's better to take the time and do the work to be sure that this is a good decision."

SandBoxBlogs: KDNK "GarCo Commissioners Postpone Disputed Compressor"
(See original story and public commentary here (and) Marianne Ackerman's "shame on CMC" story with public commentary here)
Yes, your comments on observations from the BOCC meeting itself, your comments observing that the PI appears to once again be sheltering public news coverage of a crony that happens to be in a negative public light and your comments praising the student group and CMC Trustees for their handling of the compressor station issue have all been received here on SandBox.
The reason a post on the commissioner meeting hasn't been put up yet is because 'Nanny' was giving the PI a chance to step up. The only one who covered the meeting in depth was KDNK. An organization that is never afraid to publicly voice controversial issues and does so (always) with balance, fairness and journalistic integrity.
Since everything else of 'hot worth' from that same meeting has been covered by the PI already and without completely buying in to the 'conspiracy theory' portions of your avatar comments...'Nanny' thinks you're probably right. 'Somebody' must be upset out there and is trying to once again pass their bad behavior off on to your/our 'anonymous' voices.
After thinking over what the next best step is (and hopefully laying the issue y'all have to rest at the same time...) on 'how' to spin/shock-jock/ignore the behavior in question and still give your voices an outlet; 'Nanny' has come right back to where she always ends up:
With that said, here are her thoughts on where the compressor issue is at:
Kudos!!! To the kids.
The group of young people led by Alex Curtis have the ethical and proper approach. Far better way of handling things than to bully up in the local newspaper writing letters of "shame" and throwing ones weight around. It doesn't matter who the parents of these young people are (or) who is publicly/socially influencing them to stand up.
What matters is that they are. And doing so in a class act manner. These young people we all can be proud of, whether we agree with them or not.
Yes, it is nice to have also received a now on public record statement from Jim Nieslanik that he did indeed know (months in advance, complete with a set of his own drawings) that the compressor station was coming. Sort of like all those noxious weeds that donated land is filled with not ever receiving a neighborly hand in control, Nieslanik sounds like he just may understand now that he and his family are no different, no more special than anyone else.
That if he wants to be kept abreast of what is going on in the front yard, he needs to step out into that yard on his own volition. Source Gas or anyone else doesn't owe him their time and consideration simply because of his longevity in the community. And keep the preaching and righteous indignation to himself. Or express it at a public meeting in the proper format so we can all get him on permanent record.
'Nanny' comes back to her original thought on the issue itself. A simple thought that she feels speaks volumes.
Deal with a bully...then ignore a bully.
And trust in our valued, stellar reputed CMC Trustees to continue making good decisions that are in the best interests of CMC and the community.
As with the "shame" letter from Ackerman coverage, 'Nanny' feels the feeding frenzy in commentary needs to remain blocked. For now. Let's give the commissioners a chance since they just got on board and continue trusting in our elected CMC Trustees.

SandBoxBlogs: Glenwood Springs Post Independent "SourceGas compressor proposal on hold for six months"
(See update to this post here)
How subtle is power abuse? For that matter, how corrosive can it be when it seeps into the lifeblood of a community? A region? How about the ability to take on a life of its own when it has the power of media in its back pocket?
Powerful enough to sway policies? Develop a loyal 'following' of possibly weaker individuals?
Strong enough to last for say...oh, '40 years' or more? Tenacious enough to insist on using the same (or similar) methods over and over again to get what it thinks it wants from others?
'Shame, shame' on 'anyone' who would resort to such tactics as to condemn a revered institution such as CMC. (See related story and public comments here)
SandBox thanks CMC and our Trustees for bringing upstanding leadership, so many wonderful programs and excellent stewardship of public trust to our mountain communities. You are appreciated.
John Colson:
"“They did hear loud and clear, do not do it at this location,” said Marianne Quigley Ackerman. Her father was among the ranchers who donated land for the college...." (Read more? Click title)

(See related stories and public commentary here)
John Colson:
"....Marianne Quigley Ackerman, whose father was another of of the ranchers who donated land for the college campus, said as much in a letter to neighbors that she provided to the Post Independent.
“The project is being ‘fast tracked' through our county process because, according to SourceGas, it has been budgeted this year and has to be built this year or [it] will lose funding,” Ackerman wrote.
Ackerman called that a “very weak excuse for a zoning change of this caliber with long reaching negative affects.”...." (Read more? Click title)
